These Terms & Conditions (“Terms”) govern your access to and use of the investor portal at portal.totalchb.com and related forms, pages, and services (the “Site”) operated by Total Cash Home Buyers, LLC (“Total Cash Home Buyers,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

1. Acceptance of terms

By creating access, submitting a form, or otherwise using the Site, you represent that you have read, understood, and agree to be bound by these Terms. These Terms may be updated as described in Section 14.

2. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Site. By using the Site, you represent that you meet these requirements and that any information you provide is accurate and current.

3. The service

The Site is an investor portal that allows prospective buyers to request and view property data, request property data access keys, schedule property showings, and submit offers to purchase properties from Total Cash Home Buyers, LLC. We may add, change, suspend, or discontinue features of the Site at any time.

4. Access keys & verification

Access to certain property data requires an access key and email verification, including one-time codes (OTPs) sent to you. You are responsible for keeping your access key and verification codes confidential and for all activity that occurs under your access. Do not share your access key or codes with others. Notify us promptly at info@totalchb.com if you believe your access has been compromised. We may revoke access at any time, including for misuse.

5. Showings & offers

Requests to view a property and preferred showing times are requests only and are subject to availability and our confirmation. Any offer you submit through the Site is a non-binding expression of interest. No offer, communication, or use of the Site creates a binding agreement to buy or sell any property. A binding obligation arises only upon a separate, written purchase agreement signed by both you and Total Cash Home Buyers, LLC. We may accept, reject, counter, or withdraw from any potential transaction in our sole discretion.

6. Text messaging terms

If you opt in on a Site form, you consent to receive text messages from Total Cash Home Buyers, LLC at the mobile number you provide. We offer separate, optional transactional (non-marketing) and marketing messaging programs. Message frequency may vary. Message and data rates may apply. Reply HELP for help and STOP to unsubscribe; you may also opt out by any other reasonable method. Consent to marketing messages is not a condition of purchasing any property or using the Site. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for how we handle mobile information.

7. Property data & no professional advice

Property information is provided “as is” and for general informational purposes only. Square footage, condition, valuations, liens, title status, photos, and other property details may be estimated, incomplete, or inaccurate, and are not guaranteed. You are responsible for conducting your own independent due diligence and inspections before making any decision. All properties are offered “as-is, where-is,” without warranty of any kind.

Nothing on the Site constitutes legal, tax, financial, investment, appraisal, or real estate brokerage advice. You should consult your own licensed professionals before entering into any transaction.

8. Acceptable use

You agree not to:

  • Provide false, misleading, or another person’s information without authorization.
  • Access or attempt to access data, accounts, or systems you are not authorized to use.
  • Scrape, harvest, copy, or redistribute property data or other Site content except as expressly permitted.
  • Interfere with, disrupt, probe, or attempt to bypass the security of the Site.
  • Use the Site for any unlawful, fraudulent, or harmful purpose, or in violation of any applicable law.

9. Intellectual property

The Site, including its content, design, logos, and software, is owned by or licensed to Total Cash Home Buyers, LLC and is protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Site for its intended purpose. You may not reproduce, distribute, or create derivative works without our written permission.

10. Disclaimers

THE SITE AND ALL CONTENT AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY PROPERTY DATA IS ACCURATE OR COMPLETE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOTAL CASH HOME BUYERS, LLC AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify and hold harmless Total Cash Home Buyers, LLC and its owners, members, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.

13. Governing law & disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. You agree that any dispute arising from these Terms or the Site will be resolved exclusively in the state or federal courts located in Broward County, Florida, and you consent to their jurisdiction.

14. Changes to these Terms

We may revise these Terms at any time by posting the updated version on this page and updating the “Last updated” date. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
